How a Pennsylvania Workers’ Compensation Claim Develops
- Report the injury. Tell the employer as soon as possible and preserve written proof.
- Get appropriate medical care. Determine whether a valid panel-provider rule applies during the first 90 days.
- Review the carrier’s documents. The employer or insurer may accept, temporarily accept, or deny the claim.
- Document disability and treatment. Keep medical restrictions, work notes, wage records, bills, and correspondence.
- Address disputes through the petition process. A Workers’ Compensation Judge may decide contested issues.
- Evaluate any proposed settlement carefully. A compromise and release can permanently resolve some or all rights.
Frequently Asked Questions About Pennsylvania Workers’ Compensation
What should I do immediately after a workplace injury?
Get appropriate medical care and report the injury to the employer as soon as possible, preferably in writing. Pennsylvania Section 311 generally delays compensation until notice is given if the employer did not already know of the injury, and generally bars compensation if notice is not given within 120 days, subject to statutory rules for certain injuries and occupational diseases. Preserve photographs, witness information, medical records, and communications.
What benefits may Pennsylvania workers’ compensation provide?
The system may provide payment for reasonable and necessary medical treatment related to a work injury and wage-loss benefits when the injury prevents or limits work. Depending on the facts, specific-loss, death, or other benefits may apply. Benefit amounts and duration are governed by the Workers’ Compensation Act.
Can I choose my own doctor for a work injury?
Choice can depend on whether the employer established and properly posted a compliant list of designated providers and gave the required notice. When those requirements are met, an employee may be required to use a listed provider for 90 days from the first visit. After that period, or when the employer does not have a compliant list, the employee may generally choose another provider. Emergencies and other exceptions can apply.
What happens if the insurance carrier denies the claim?
A denial does not necessarily end the matter. An injured worker may file an appropriate petition with the Pennsylvania Bureau of Workers’ Compensation, and the dispute may be assigned to a Workers’ Compensation Judge. Different petitions and deadlines can apply, so the denial notice, injury date, medical evidence, and wage records should be reviewed promptly.
Can a work injury also create a third-party claim?
Possibly. Workers’ compensation generally addresses the employer-employee claim, but a separate claim may exist against a negligent person or company other than the employer, such as a property owner, equipment manufacturer, or motorist. Coordination and subrogation issues can affect the recoveries.
Do I have to hire a lawyer for a workers’ compensation claim?
No. A person may proceed without counsel, but legal advice can be useful when a claim is denied, benefits are stopped or modified, the worker cannot return to the same job, a settlement is proposed, or a third-party claim may exist. The need for representation depends on the facts.
