“Highly Recommended” is the epitome of an understatement when it comes to the firm of McDonald At Law!! Michael McDonald’s genuine pleasant, and empathetic demeanor masks his legal astuteness, and the level of aggressiveness he implements in pursuit of a victim’s right and the monetary compensation legally entitled to us. I was involved in a motor vehicle accident at the hands of an intoxicated driver in York County. In my case I suffered what I described as an atypical injury, Mr. McDonald offered to be my Lawyer immediately after explaining to him the events leading to and after being struck in turn causing me to have a heart attack, when another law firm seemed hesitant. McDonald At Law secured a sizable monetary compensation that not only met my expectation but exceeded it. Mr. McDonald’s wealth of experience, and legal prowess is priceless and never did he act as the case was beneath his practice. In the end my family and I were well compensated, but also felt justified. Thank you McDonald At Law!!

Back in 2014 I was injured didn’t know what to do but my wife suggested I call Mike McDonald at law I’m not going to say that I really believe in luck but I will say it was the greatest blessing of my entire life that I had the opportunity to pick the best lawyer in Pennsylvania and maybe all of America in Mike McDonald. I needed surgery and Mike came to my home just to make sure that I was OK personally, and he told me not to worry about anything but to just get well he really cares about people and that is something you can’t pay for. Mike’s firm was the most professional operation I have ever had the opportunity to witness over the last 3 1/2 years . All I can say is this if you’ve been injured and you need help there’s only one person that you should call and that’s McDonald at law. From my experience is that when I arrived at his office the first time I met a lawyer and when I left his office the last time I felt like I had a friend. For superior service and expert litigation, remember there’s only one number to call if you ever get hurt it’s McDonald at law.

Chester County Car Accident Lawyers
A car crash in Chester County can create several problems at once: medical appointments, a damaged vehicle, missed work, and insurance calls before you know how long recovery may take. A useful claim starts by preserving what can disappear quickly and by understanding which Pennsylvania rules apply to the specific crash.
Car Accident Claims in Chester County
Chester County includes busy regional routes, growing suburban areas, borough streets, and rural roads. Crashes on U.S. Route 202 near West Chester and Exton can involve very different evidence from collisions on U.S. Route 30 through Downingtown and Coatesville, Route 100, Route 1, or smaller municipal roads. The exact location can determine which police agency created the report, which nearby businesses may have video, who owns or maintains the roadway, and where witnesses are likely to be found.
If a civil lawsuit is filed in Chester County, the Prothonotary serves as the civil filing office for the Court of Common Pleas. The office is at 201 W. Market Street in West Chester. Chester County also uses electronic filing for many civil matters, but filing procedure is separate from whether a claim has legal merit.
What Pennsylvania Law May Require
Under 42 Pa.C.S. § 5524, an action seeking damages for personal injuries caused by negligence generally must be started within two years. That does not mean every claim has the same deadline. Claims involving government entities, minors, deaths, or hard-to-identify defendants can raise additional timing issues.
Pennsylvania also follows modified comparative negligence under 42 Pa.C.S. § 7102. An injured person can still recover when their negligence is not greater than the defendants’ combined negligence, but the recovery is reduced by the percentage of fault assigned to that person.
For the crash itself, 75 Pa.C.S. § 3746 requires immediate notice to police when an accident causes injury or death, or when vehicle damage leaves a vehicle unable to be driven safely in its customary manner and it must be towed.
How a Claim Is Built
The police report is useful, but it is only one source. A Chester County investigation may also involve intersection or business video, dash-camera footage, photographs, event data from the vehicles, towing and repair records, phone records when legally obtainable, and statements from people who saw the collision. Evidence should be requested or preserved before routine deletion, repair, or disposal makes it harder to obtain.
Insurance review is just as important. Pennsylvania policies may include first-party medical benefits, liability coverage, and uninsured or underinsured motorist coverage. The full-tort or limited-tort election under 75 Pa.C.S. § 1705 can also affect whether noneconomic damages may be pursued, subject to the statute’s exceptions.
Practical Steps After a Chester County Crash
- Get medical help and notify police when Pennsylvania law requires it.
- Photograph the vehicles and the wider scene, including signals, signs, lane markings, debris, sight obstructions, and nearby businesses.
- Keep the police incident information, witness contacts, towing records, repair estimates, medical records, and proof of missed work together.
- Follow medical advice and document work restrictions or daily activities the injury prevents.
- Before signing a release, confirm which insurance policies may apply and whether future treatment or wage loss is still uncertain.
Mistakes to Avoid
- Assuming the police report will contain every fact needed to prove how the collision happened.
- Waiting to ask nearby businesses or property owners to preserve video that may be overwritten.
- Repairing, selling, or disposing of a badly damaged vehicle before important condition evidence is documented.
- Discussing fault or injury details on social media while the claim is being investigated.
- Treating the two-year statute as a reason to delay gathering evidence.

Frequently Asked Questions
How long do I have to file a Chester County car accident lawsuit?
Pennsylvania generally uses a two-year limitation period for a negligence action seeking damages for personal injuries. The correct deadline should still be checked early because the parties and facts can create additional requirements.
Does a Chester County police report decide who is legally at fault?
No. A report can document drivers, witnesses, statements, citations, and scene conditions, but legal fault may depend on additional evidence such as photographs, video, vehicle data, and testimony.
Can I recover if I was partly at fault?
Potentially. Pennsylvania’s comparative-negligence rule permits recovery when the injured person’s negligence is not greater than the defendants’ combined negligence, with damages reduced by the percentage assigned to the injured person.
Why does my full-tort or limited-tort selection matter?
Pennsylvania’s tort-option law can affect the ability to recover pain-and-suffering and other noneconomic damages. Limited tort has statutory exceptions, so the declarations page and signed election should be reviewed rather than assuming the label ends the issue.
Where are Chester County civil filings handled?
The Chester County Prothonotary is the civil filing office for the Court of Common Pleas. Its office is at 201 W. Market Street in West Chester, and the county provides electronic filing for many civil matters.
What evidence is most likely to disappear after a crash?
Video, witness recollections, vehicle condition, debris, and temporary roadway conditions can all change quickly. Prompt preservation is often more useful than trying to reconstruct those details months later.
