“Highly Recommended” is the epitome of an understatement when it comes to the firm of McDonald At Law!! Michael McDonald’s genuine pleasant, and empathetic demeanor masks his legal astuteness, and the level of aggressiveness he implements in pursuit of a victim’s right and the monetary compensation legally entitled to us. I was involved in a motor vehicle accident at the hands of an intoxicated driver in York County. In my case I suffered what I described as an atypical injury, Mr. McDonald offered to be my Lawyer immediately after explaining to him the events leading to and after being struck in turn causing me to have a heart attack, when another law firm seemed hesitant. McDonald At Law secured a sizable monetary compensation that not only met my expectation but exceeded it. Mr. McDonald’s wealth of experience, and legal prowess is priceless and never did he act as the case was beneath his practice. In the end my family and I were well compensated, but also felt justified. Thank you McDonald At Law!!

Back in 2014 I was injured didn’t know what to do but my wife suggested I call Mike McDonald at law I’m not going to say that I really believe in luck but I will say it was the greatest blessing of my entire life that I had the opportunity to pick the best lawyer in Pennsylvania and maybe all of America in Mike McDonald. I needed surgery and Mike came to my home just to make sure that I was OK personally, and he told me not to worry about anything but to just get well he really cares about people and that is something you can’t pay for. Mike’s firm was the most professional operation I have ever had the opportunity to witness over the last 3 1/2 years . All I can say is this if you’ve been injured and you need help there’s only one person that you should call and that’s McDonald at law. From my experience is that when I arrived at his office the first time I met a lawyer and when I left his office the last time I felt like I had a friend. For superior service and expert litigation, remember there’s only one number to call if you ever get hurt it’s McDonald at law.

Chester County Slip and Fall Lawyers

A serious fall can leave you dealing with a fracture, head injury, torn ligament, or back problem while the condition that caused the fall is already being cleaned, repaired, or changed. A Chester County slip and fall lawyer must do more than show that an injury happened on someone else’s property. The claim usually depends on who controlled the area, what made it unsafe, and what the responsible party knew or should have known before the fall.

Where Falls Happen in Chester County

Premises-liability claims can arise in grocery stores, restaurants, shopping centers, apartment buildings, medical offices, hotels, parking lots, sidewalks, and other properties from West Chester and Exton to Downingtown, Coatesville, Phoenixville, Oxford, and Kennett Square. The responsible party may be the property owner, a tenant, a property manager, a maintenance company, or a snow-removal contractor.

Control matters because different businesses can be responsible for different parts of the same property. A lease may place responsibility for an interior floor on a tenant while a landlord or management company controls the parking lot, exterior walkway, or common area.

      What Must Be Proven

For many business-invitee claims, Pennsylvania law asks whether the property possessor knew or, through reasonable care, should have discovered a condition involving an unreasonable risk of harm. Evidence may also need to show that the possessor should have expected visitors would not discover or protect themselves from the danger and failed to use reasonable care.

When the claim depends on constructive notice, details such as how long the condition existed, whether employees regularly inspected the area, whether the hazard was recurring, and whether complaints or prior incidents were documented can become important. Pennsylvania’s known-or-obvious-danger rule can also affect a claim. Under Carrender v. Fitterer, an obvious condition does not automatically end every case, but it changes the duty analysis and whether the possessor should still have anticipated harm.

      Evidence That Can Disappear Quickly

A spill can be cleaned within minutes, surveillance video can be overwritten, snow or ice can melt, and a broken walking surface can be repaired. If it is safe, photographs should capture both the exact hazard and the wider approach, including lighting, warning signs, changes in elevation, nearby displays, drainage, or anything else that affected visibility.

Other useful evidence may include an incident report, witness names, receipts showing why you were on the property, footwear, weather information, inspection records, cleaning logs, maintenance records, contracts, and surveillance video. Medical records should also document the injury and its effect on work, walking, sleep, and daily activity.

      Time Limits and Comparative Fault

Pennsylvania generally requires a personal-injury negligence action to be filed within two years under 42 Pa.C.S. § 5524. Claims involving a municipality or another government unit can involve additional notice, immunity, and procedural rules.

Under 42 Pa.C.S. § 7102, an injured person’s negligence can reduce a recovery and can bar recovery if that negligence is greater than the defendants’ combined negligence. In a fall case, that can make evidence about lighting, warnings, footwear, visibility, and the path taken especially important.

      Mistakes to Avoid

      • Leaving before the condition and surrounding area are photographed when it is safe to do so.
      • Reporting only the injury and not identifying the exact location and condition that caused the fall.
      • Throwing away footwear or clothing that may become relevant to how the fall occurred.
      • Assuming the property owner is the only possible responsible party without checking who controlled or maintained the area.
      • Waiting to request surveillance or inspection records until ordinary retention practices may have erased them.

      Frequently Asked Questions

Is a Chester County property owner automatically responsible when someone falls?

No. A fall and an injury do not by themselves prove negligence. The claim generally requires evidence about duty, control of the area, the unsafe condition, notice, causation, and damages.

What does constructive notice mean in a slip and fall case?

Constructive notice concerns whether a property possessor should have discovered the condition through reasonable care. How long the condition existed, inspection practices, recurring problems, and prior complaints can all matter.

What should I photograph after a fall?

If it is safe, photograph the exact condition and the wider area from several angles. Include lighting, warnings or their absence, elevation changes, nearby objects, drainage, footwear, and anything that helps show scale and visibility.

How can Pennsylvania’s known-or-obvious-danger rule affect a claim?

A danger that was known or obvious can change the duty analysis. Pennsylvania law still asks whether the property possessor should have anticipated harm despite the condition being known or obvious.

How do snow and ice rules affect a Chester County fall claim?

Pennsylvania’s hills-and-ridges doctrine can apply to generally slippery conditions caused by natural snow or ice accumulation. It does not decide every winter-fall case, so the exact condition and cause still need to be examined.

How long do I have to file a Pennsylvania slip and fall lawsuit?

A personal-injury negligence action generally must be filed within two years under 42 Pa.C.S. § 5524. Public-property claims and other circumstances may involve additional rules.
